These terms are a contract between you and HellaGood ("we," "us"), based in California. By creating an account, checking the "I agree" box at signup, or using the service, you agree to all of them and to our Privacy Policy. If you're agreeing on behalf of a restaurant or company, you promise you have the authority to bind it.
In short: we use AI to build and host a website for your restaurant, for a monthly fee.
HellaGood builds, hosts, and helps you maintain a website for your restaurant using automated (AI) tools plus human review. The service is offered month to month. Current pricing is shown on our site; early-access pricing may change for future billing periods with at least 30 days' notice. Features may be added, changed, or removed at any time — the service you buy is the service as it exists, not any future roadmap.
In short: your menu, photos, and business info stay yours — and you promise you have the right to use them.
Everything you upload or give us — menus, prices, photos, logos, business details, text ("Your Content") — remains yours. You give us a non-exclusive license to store, process (including with AI services), display, and publish Your Content solely to provide the service.
You promise that you own Your Content or have permission to use it. That includes photos (no images pulled from the internet, other restaurants, or photographers you haven't licensed), your logo, your menu text, and your business name. If someone claims content you gave us infringes their rights, that's on you (see section 13), and we may remove the content or the site while it's sorted out.
Showcase: we may feature sites we've built — including yours — in our own marketing, portfolio, and examples. If you'd rather we didn't feature yours, tell us and we'll stop.
In short: your content and data are yours forever. The design and code we generate are ours — you license them while you subscribe, and you can buy them if you ever want to own them.
The website designs, layouts, code, and visual systems HellaGood generates (the "Design") are and remain the property of HellaGood. While your subscription is active, you have a license to use the Design as your live website. If you cancel or the subscription ends, that license ends: the site comes down and the Design does not go with you.
What does go with you, anytime, free: Your Content and your structured data (menu, prices, hours, business info) — ask and we'll export it.
Design buyout: if you want to own your site's design and code outright, we offer a one-time purchase — contact us at hello@hellagood.food for current buyout pricing. After a buyout, the delivered copy of the Design is yours.
In short: nothing goes live without your OK — which also means what's live is on you.
Our workflow requires your approval before a site or a design change goes live (small data edits you make yourself are live when you publish them). By approving or publishing, you confirm the content is accurate and you have the rights to it. AI-generated text and layouts can contain errors — review before you approve.
In short: we transcribe your menu with AI; you're responsible for checking it — especially prices and allergy info.
We read menus from photos using AI. It's good, but not perfect: items, prices, descriptions, and translations can be transcribed incorrectly. You are responsible for reviewing your published menu and correcting errors (your portal makes this a tap). We are not responsible for any loss, claim, or injury arising from menu inaccuracies — including pricing errors, item availability, or missing or incorrect allergen and dietary information. Allergen and health information on your site is provided by you and is your responsibility.
In short: month to month, cancel anytime, no refunds.
In short: we work hard to keep sites up, but we don't promise any uptime level.
We host on reputable infrastructure and care a lot about your site being up. However, the service is provided without any uptime guarantee or service-level commitment. Outages, maintenance, third-party provider failures, and internet weirdness happen; we are not liable for downtime or anything you attribute to it (like lost orders or customers).
Don't use HellaGood for anything illegal, deceptive, infringing, or harmful. We may refuse, suspend, or remove any site or content that we reasonably believe breaks the law, infringes rights, harms others, or damages the service or our reputation — with or without notice. We can end service to anyone; if we end it without cause, we'll refund the unused portion of the current month (the one exception to no-refunds).
Sites live at yourname.hellagood.food. Subdomains belong to HellaGood; we assign them first-come, first-served and may reclaim or change a subdomain in cases of trademark conflict, impersonation, abuse, or a cancelled subscription. Custom domains you connect remain yours — we never register, own, or renew domains on your behalf.
If you believe a site we host infringes your copyright, email hello@hellagood.food with: (1) the URL, (2) the work you own, (3) your contact info, (4) a statement of good-faith belief the use is unauthorized, and (5) a statement, under penalty of perjury, that you're the owner or authorized to act. We respond to valid notices by removing or disabling the material and may terminate repeat infringers' accounts.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING. WE DO NOT WARRANT THAT THE SERVICE OR AI-GENERATED OUTPUT WILL BE ERROR-FREE, UNINTERRUPTED, OR MEET YOUR REQUIREMENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL; AND (b) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions don't allow certain limits; in those, our liability is limited to the smallest amount the law allows.
You will defend and hold HellaGood harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Content, your menu or allergen information, your use of the service, or your violation of these terms or anyone's rights — including copyright and trademark claims about photos, logos, names, or text you provided.
In short: California law; talk to us first; then binding arbitration, one-on-one — small-claims court always allowed.
These terms are governed by California law. Before filing anything, email us — most issues get fixed fast. Any dispute that can't be resolved informally within 30 days will be settled by binding individual arbitration in Los Angeles County, California (or by phone/video), administered by a recognized arbitration provider under its consumer rules. You and HellaGood each waive the right to a jury trial and to participate in a class action. Either party may instead bring an individual claim in small-claims court. If the class-action waiver is found unenforceable, this entire arbitration section is void.
We may update these terms; material changes get at least 14 days' notice (email or portal). Continuing to use the service after a change takes effect means you accept it. Each version is dated at the top.
